There is a reason we now include the following phrase on the main page of our site:
"Users in areas that have ID Verification laws are not permitted on Drako's Den"

We, The DWS Team, are excercising our rights, and the protections, within The Computer Fraud and Abuse Act (CFAA) along with protections afforded us under COPPA, The First Amendment's right to Free Speech and Expression, and other laws, to issue the following statement.

We are a small operation that has been a hobby creation of our Founder, who is the primary webmaster and coder for all projects created by DWS. Ergo, we do not have the legal teams, or the finances available, to enact paid technologies under ID verification laws -- or the time to MANUALLY review all IDs of site users: which would require users to post those IDs in spaces where other users may somehow gain access. Therefore, we have no way to fully verify IDs at this time that ensures the safety and privacy of our users.

Drako's Den has always been a beacon of the Freedom of Expression for it's users. Operating under the mantra "There is a time and a place for everything" - and have allowed users to freely express themselves on Drako's Den within the appropriate places to do so, so long as that expression did not violate any laws. (Like CSAM - which has been forbidden by DWS and our hosting parters from the very beginning.)

This includes areas where Drako's Den as allowed Adult (18/21+) content posted by it's users. Of which we have only done extremely limited moderation to prevent the posting of illegal activites and SPAM/SCAMs from users. Under our Terms, users who post such content must maintain - and be willing to provide 18 USC 2257 documentation in regards to anyone featured in content they post.

Therefore, we have always done "best faith efforts" and even went further than other adult websites in our attempts at keeping underage users off our platform. This includes the fact that we have always required a full Date of Birth entry under penalty of perjury before allowing users access to our platform. We have also made changes from our eary years to requre users to sign up and login to their own Drako's Den accounts to access these User Created posts that may contain Adult Content.

Under the Computer Fraud and Abuse Act, any user unauthorized to access Drako's Den due to age restrictions, and shows the willingness to lie about their age, have committed their own Criminal Acts to gain this access. Protecting The DWS Team under the Act. We also firmly believe that if the rest of the industry was willing to go as far as we did, the ID Verification laws would never have been considered in the first place.

Also, there are currently no ways for any website to query an OS for any "Age Data" the OS may have on users. (As propsed in some laws like in CA) Not to mention that in accordance to certain laws, there is no way to confirm that the current user of an OS is the same as the person who setup the computer -- much less that they are the same age. Therefore, there is no way a website like ours can receive and ensure age data from an OS attestation is indeed accurate.

This also compounds the fact that every current system for ID Verification creates privacy concerns. Especially since all of the few companies invloved in full and proper ID verification processes have been compromised to the point that users undergoing the process of ID Verification may have their information intercepted by bad actors in real time - during the ID Verification process itself.

Therefore, there is no way any platform can require ID Verification and offer any level of assurances to user privacy.

We have also seen evidence of more robust "Age Verification" systems actually making mistakes.

• For instance, an ADULT had a "GLitch in the Matrix" posted to Tiktok, only for Tiktok to completely ban her account because the AI Facial software deemed she was under 13 -- and refused to re-instate the account even after being provided proof of age:
  
• Or in this video talking about the CA law, this person admits an interesting fact. If laws around in person sales only require ID checks if a person "appears under 35" then all ID check laws will be flawed.
  Why? Because this individual could have been able to buy alchohol without ever being "carded" simply because his beard made him appear old enough, he claims this was when he was in his 20s. He even noted that middle school kids have the same exact beard powers.
  

In the aforementioned video, he goes on to reiterate our views on these laws:

• They are being written by people who have no idea how technology or the internet works.
• Computer systems are not going to be safe or accurate enough to ensure safety and privacy of users going through the Age Verification process -- while giving users the wrong age bracket.
  ie: The software has claimed our Founder -- who was born in 1984 (do the math) was only 16 because his face looks young.
• Website and Computer developers can EULA their way out of these laws by simply making it "illegal" to use their websites/software in areas with said laws.

So, we are excercising our right, under all applicable laws, to declare the following:

• Users who reside in any jurisdiction that requires full ID Verification or OS level Age Declarations while not accepting DOB entry prompts, under penalty of perjury, as a "protected mode" of verification are not permitted to access Drako's Den -- or the contents within the Age Restricted areas of Drako's Den.
• Any user who enters false information to gain Access to Drako's Den, including within the DOB entry prompts, is in violation of the Computer Fraud and Abuse Act, and is doing so under penalty of perjury.
• Any user within ID Verification jurisdictions who accesses Drako's Den is also in violation of the Computer Fraud and Abuse Act, as it would be an impossible feat for us to use location based blocks (via scripts) to Drako's Den. Due to the scripts need to change along with a user's use of VPNs to circumvent those bans.
